TERMS & CONDITIONS

this forms the basis of our contract, so please do make sure you read it

It is mutually agreed that the following terms and conditions form an integral part of this agreement and that no variation or modification of this agreement shall be effective unless accepted by both YBPHOTOGRAPHIC LTD (“the photographer”) and the client (“you”), in writing.

This agreement constitutes an order for wedding photography as agreed to by both parties. It is mutually agreed that the photographer shall provide services and/or goods as specified and that you shall pay the photographer the amount due for said services and/or goods on the due date set out below.

Booking Fee

The booking fee of £250 secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation by the Client, it being the agreed loss suffered by the Photographer due to the cancellation. Dates are reserved only when the fee and signed agreement has been received and accepted by the Photographer.

Balance Payment

The balance payment is to be made no later than 30 days prior to the wedding ceremony. All financial agreements and payments will be strictly enforced. Payment for photographic prints, albums and other products is to be made at the time of ordering and will be charged at the prices in effect at the time of ordering.

Responsibilities

The Client may delegate payment of the services to a third party, but YBPHOTOGRAPHIC’s obligation to provide the agreed services extends to the Client only. The Client remains responsible for any payments due under these Terms and Conditions.

Artistic License

The Photographer shall be granted creative and artistic license in relation to the poses and compositions photographed and the locations used. The Photographer’s judgement regarding the poses, compositions and locations and the number of photographs taken shall be deemed correct. Due to the vagaries of the weather, the willingness of subjects and circumstances on the day it may not be possible to capture all the images requested. The Photographer will do their best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. You will be shown all of the photographs taken on your wedding day apart from blinks, half blinks, duplicate shots, missed facial expressions or images blocked by third parties. These images will be deleted either in camera or during the editing stage.

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer programs including any source or object, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or my any other means an image created as part of this contact without the permission of the Photographer in writing. All rights and copyrights to the photographs remain with the photographer. Any digital images supplied to the client by YBPHOTOGRAPHIC as part of the agreed terms will be accompanied by an unlimited non-commercial reproduction license.

Images

All images will be delivered in print-ready. high resolution JPG format ready for printing by the client. Cosmetic retouching or additional digital manipulation is available to the Client as an optional extra. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to digitally record exact colour as seen by the human eye. Images will be delivered within 1 month of the wedding date. The photographer will keep the digital negatives of your images for a minimum period of 48 months from the date of your wedding.

Display

The YBPHOTOGRAPHIC may display any photographs included in this contract in their studio, portfolio, literature, display areas, exhibitions, competitions, advertising, website and slide shows, provided that they are used lawfully and without harm to the Client.

Exclusivity

YBPHOTOGRAPHIC LTD shall be the sole professional stills photographer(s) at the venues and dates specified. Simultaneous photographic coverage by another professional photographer, or other vendor where the photographs are to be offered for sale or included as part of their package releases the photographer from this agreement and immediately terminates service coverage. In such an event, all monies paid shall be non-refundable.

Family, friends and other guests are welcome to take photographs throughout the day, apart from during the couple’s portrait session when YBPHOTOGRAPHIC LTD shall be the only camera present. If any conditions arise which are interfering with proper photographing procedures, the photographer will make reasonable effort to proceed. If such interference continues, then it is within the photographer’s discretion to cease work until the situation is resolved.

Videographers

Video coverage may compromise photographic coverage. The Photographer will work alongside video companies entirely at the Client’s own risk with regards to the photographic record of the day and under the provision that photographic coverage has ‘priority’ on the event day itself.

Venue/Location Rules

YBPHOTOGRAPHIC is limited by the guidelines and/or restrictions imposed by the ceremonial official and/or venue management. The Client agrees to accept the impact of any such restrictions on the Photographer.

Force Majeure

In the unlikely event of total photographic failure, death, injury or sickness beyond the photographer’s control, the photographer’s liability shall be limited to a full refund of all monies paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail or otherwise lost or damaged. Your statutory rights are not affected. The photographer has full Public Liability and Professional Indemnity Insurance.

Government Interference

Should any act of government prevent the ceremony from going ahead, YBPHOTOGRAPHIC will allow the transfer of the Booking Fee to any new date within 12 months of the originally date free of charge, strictly subject to availability. If the Client chooses to cancel the booking altogether, this will be treated as a Cancellation under the terms above.

Cancellation

If the photographer has to cancel this agreement for reasons beyond their control (e.g. death, injury, sickness, etc.) their liability shall be limited to a full refund of all monies paid (including the booking fee). In no circumstances will the Photographer be liable for any consequential loss or expenses. YBPHOTOGRAPHIC will make every attempt to recommend a suitable replacement to the Client, but cannot guarantee to do so. YBPHOTOGRAPHIC will not be liable for the charges of any recommended replacement photographer(s), nor are we responsible for the performance of any replacement photographer(s).

As compensation for loss of income for YBPHOTOGRAPHIC LTD, if the Client cancels this agreement the following charges shall apply:
•     21 days or less before the event date – 100% of the fee due;
•     more than 21 days before the event date – £250 (in the form of the date Booking Fee already paid).

A postponement of the wedding date will be treated the same as a cancellation, and the booking for the new date (subject to availability) shall be at the fee which is in effect at that time. The request for cancellation or postponement must be made in writing (not email) to YBPHOTOGRAPHIC LTD and be signed by all signatories to this agreement. (We recommend wedding insurance to cover any eventualities.)

Post-Wedding Product Orders

All post-wedding product orders shall be treated as an extension of this contract and no responsibility will be accepted unless orders are given in writing. The Client may order unlimited enlargements, reprints or albums from the photographer for personal use but not for any commercial purposes. The photographer will keep the digital negatives of your images for a period of 48 months from the date of your wedding.

All orders are bespoke, must be paid for at the time of ordering, and cannot be cancelled once work is in progress. No returns will be accepted unless the product is faulty. Orders will be processed strictly in the order within which they were received.
